Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use our platform solely for your personal or internal business purposes. This license does not include the right to reproduce, distribute, modify, or create derivative works from our content without explicit written permission.

2. Screenshots or recordings of our platform content require prior written consent
3. The Pephyr name, logo, and branding elements may not be used without permission
4. User-generated content remains the property of the user but grants us usage rights

• Refunds are provided according to our refund policy available on our website

• Failure to pay fees may result in suspension or termination of services

Auto-Renewal: Subscription services automatically renew at the end of each billing period unless canceled prior to the renewal date. You may cancel your subscription at any time through your account settings or by contacting our support team.

8. Disclaimers and Limitations of Liability

The Pephyr platform and all content and services are provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

While we strive to provide accurate and up-to-date cybersecurity information and training, the field of cybersecurity evolves rapidly. We do not warrant that our content will always reflect the most current threats, vulnerabilities, or best practices. Users should supplement our training with current industry resources and professional consultation where appropriate.

Limitation of Liability: In no event shall Pephyr, its officers, directors, employees, partners, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from your use of our platform.

9. Termination

Either party may terminate this agreement at any time. You may terminate your account by discontinuing use of the platform and canceling any active subscriptions. We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including but not limited to a breach of these Terms of Use.

Upon termination, your right to use the platform will cease immediately. All provisions of these Terms of Use which by their nature should survive termination shall survive termination, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

2. Paid subscriptions may be eligible for prorated refunds based on our refund policy
3. Access to course materials and certifications may be retained according to our retention policy
4. We reserve the right to retain certain data as required by law or for legitimate business purposes

10. Governing Law and Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising from or relating to these terms or your use of the Pephyr platform shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 2015.

The arbitration shall be conducted in Gorakhpur, Uttar Pradesh, India, and shall be conducted by a single arbitrator agreed upon by both parties. If the parties cannot agree on an arbitrator within 30 days, the arbitrator shall be appointed by the applicable arbitration institution.

11. Changes to Terms

We reserve the right to update or modify these Terms of Use at any time without prior notice. When we make changes, we will post the updated terms on this page and update the "Effective Date" at the top of this document. Your continued use of the platform after any such changes constitutes acceptance of the new terms.

For significant changes that materially affect your rights or obligations, we will make reasonable efforts to notify users through email or prominent notices on our platform at least 30 days before the changes take effect.
